[opening paragraph]: On page 2 of this volume our co-editors set admirable goals. They seek ‘method- ologies that can provide an open link to objective, empirically based description'. Moreover, they want ‘explicit examples of practical knowledge, in case studies'. My comments will address these words and goals. I too prefer the case-method approach, and seek practical ways to access states of consciousness. Then, at the top of page 4, Professors Varela and Shear define ‘nonconscious phenomena’ as those the subject is (...) not aware of. In order to comment further on this issue of awareness and non-awareness, I'll first need to pick up on their other key word -- ‘blindness’ -- as introduced in their section VII. I'll then redirect it. For surely a central topic to confront is our own self-imposed blindfold. Which subterranean region of consciousness are we most unaware of? What thwarts our efforts to study all of its regions? Our own covert self. (shrink)

In Method in Theology (chapter 3) Lonergan points to a parallel between instances of a mediated return to immediacy: “Finally there is a withdrawal from objectification and a mediated return to immediacy in the mating of lovers and in the prayerful mystic’s cloud of unknowing.” Soto’s essay explores the question: “If it is possible, as some couples report, for the mating of lovers to be a prayerful, mystical experience, what does this mean?”Soto explores the physiological, psychological and spiritual dimensions (...) of the lover’s immediacies. She finds three centers of natural immediacies in the lovers’ return via their lovemaking, and one supernatural immediacy. They include a primitive psychological state, Lonergan’s notion of spontaneous intersubjectivity, and the self-presence of contemplation. All three immediacies have transformative potential for the lovers, and position them for mystical experience. The fourth center of immediacy is the supernatural gift of the indwelling Christ. His presence in the lover’s awareness is mystical immediacy. Christ is mediator and mediated in the couple’s objectification of their mystical immediacy and their ensuing graced living, or, life of prayer.Through scholarly research and supporting, concrete interviews of couples, Soto sketches out some of the ways the lovers cooperate with the precept to “be in love.” The ethic is framed around the developments and conversions in Lonergan’s trajectory that moves from eros to friendship and to a special order of charity. Ethics committees and academics tend to concentrate on unusual and exciting cases. Should they pay more attention to less glamorous issues which are neglected because they are so familiar? Is there a definable point at which practical problems become ethical concerns?

Objectives: To study the consent process experienced by participants who are enrolled in a molecular genetic research study that aims to find new genetic mutations responsible for an apparently inherited disorder.Design: Semi-structured interviews and analysis/description of main themes.Participants: 78 members of 52 families who had been recruited to a molecular genetic study.Results: People were well informed about the goals, risks and benefits of the genetic research study but could not remember the consent process. They had mostly been recruited to take (...) part by trusted clinicians or their relatives but had little memory of, or concern about signing consent forms. Families appeared to regard the research as a continuation of their, or their relatives’, clinical care.Conclusions: Ethical review should be more flexible in its attitude to consent forms and written information sheets for some sorts of research. For rare genetic disease studies where research has been discussed fully within the clinical setting then the consent obtained at that time could suffice rather than needing extra consent at a later stage. However, clinician-researchers will need to ensure that their duty of care extends for the duration of the research and beyond. (shrink)

Military reproductive health policies affect large numbers of women. In 2006 servicewomen numbered nearly 350,000 and comprised 14.5% of active-duty forces and 17.4% of the reserve force. In addition, approximately 165,000 female dependents of active duty military personnel and 157,000 female dependents of reserve duty personnel are between the ages of 12 and 22 and are eligible for military health care services. Dependents of military personnel are eligible for military health care coverage until age 21, or up to the age (...) of 23 if considered a full-time student.About 10% of active duty female servicemembers become pregnant each year. Pregnant servicewomen are considered non-deployable and are usually not assigned to overseas commands. Pregnant women in the Army, the service branch with the greatest number of women on active duty, can choose to remain on active duty, request temporary leave from service, or request separation from service. Separation options include either discharge, honorable or uncharacterized depending on rank, or transfer to individual ready reserve. (shrink)

Women's access to reproductive health care is an ongoing source of conflict in U.S. politics; however, women in the military are often overlooked in these debates. Reproductive health care, including family planning, is a fundamental component of health care for women. Unintended pregnancy carries substantial health risks and financial costs, particularly for servicewomen. Compared with their civilian counterparts, women in the military experience greater challenges in preventing unwanted pregnancy and have less access to contraceptive services and abortion. Current military policies, (...) federal laws, and health care practices are not always consistent with evidence-based research and patient-centered care. A multidisciplinary effort on the part of military personnel, lawmakers, and health care providers is needed to eliminate these disparities. We discuss recommendations in the following categories: improving contraceptive education and adherence, expanding research, broadening access to the full range of contraceptive options including emergency contraception, and ensuring access to safe abortion. Under the trees, along (...) the pale slopes of sand, I walk in an ascendent relationship to rapture, and with words, I celebrate the rapture. I see, and dote upon, the manifest.”1 She speaks as a poet and not as a philosopher or religious scholar, but she does so as one who is ardently in touch with the sacredness of nature. Her vocation as a poet is testimony to this constant attunement. Her daily walks in the woods and by the sea are her portals of access to the temple of the natural world. Her every step makes contact with holy ground.Oliver’s poetic vocation shows itself to be in deep sympathy with all of the living and nonliving aspects of nature, and thus with the imminent ecological crisis of our time, when she reflects later in this same book, “The farthest star and the mud at our feet are a family; and there is no decency or sense of honoring one thing, or a few things, and then closing the list. Objective: There are benefits and risks of giving patients more granular control of their personal health information in electronic health record (EHR) systems. When designing EHR systems and policies, informaticists and system developers must balance these benefits and risks. Ethical considerations should be an explicit part of this balancing. Our objective was to develop a structured ethics framework to accomplish this. -/- Methods: We reviewed existing literature on the ethical and policy issues, developed an ethics framework called a “Points (...) to Consider” (P2C) document, and convened a national expert panel to review and critique the P2C. -/- Results: We developed the P2C to aid informaticists designing an advanced query tool for an electronic health record (EHR) system in Indianapolis. The P2C consists of six questions (“Points”) that frame important ethical issues, apply accepted principles of bioethics and Fair Information Practices, comment on how questions might be answered, and address implications for patient care. -/- Discussion: The P2C is intended to clarify whatis at stake when designers try to accommodate potentially competing ethical commitments and logistical realities. The P2C was developed to guide informaticists who were designing a query tool in an existing EHR that would permit patient granular control. While consideration of ethical issues is coming to the forefront of medical informatics design and development practices, more reflection is needed to facilitate optimal collaboration between designers and ethicists. The conclusions drawn from the observed patterns are relevant to the behaviour of expanding cell populations during tissue growth and homeostasis. I seek to emphasize Immanuel Kant’s lingering and unsavory impact on medical ethics by emphasizing Kantian ethics’ disregard for non- rational humans. We must be considerate when discussing individuals who have some form of dementia, conditions that irreversibly diminish the ability to use rational thought, sometimes to a degree of severity that hinders essential daily functions. I argue that to consider ourselves proponents of human equality we must treat humans with dementia as members of the kingdom of ends.

This article argues for a transregional historical approach to explain the career of political secularism, i.e. the ideas and practices that inform the modern state’s relationship to and administration of religion, in the 20th century. More specifically, it asks in how far we can understand secularism in South and Southeast Asia between the end of the First World War and decolonisation after 1945 as a result of transregional patterns that evolved within and beyond these regions. The argument is based on (...) three brief case studies on Atatürk’s Turkey as a contested source of inspiration for state secularity and religious reform, regional women’s networks to foster secularism and social change in the 1930s, and secularism as a strategy of postcolonial state-building and territorial integration. Maryknoll, NY: Orbis Books, 2001. 276 pp.Why read Jacques Dupuis's Christianity and the Religions (2001) when his more comprehensive, ground-breaking Toward a Christian Theology of Religious Pluralism (Orbis, 1997) is still available? Father Dupuis reminds us in the introduction to Christianity that he has actually written three books (...) on the same subject—Jesus Christ at the Encounter of World Religions (Orbis, 1991) being the first—but he reaffirms the central importance of Religious Pluralism. After publication of this second work, his editors wanted another volume on the same topic, "less ponderous, more accessible, and aimed at an audience broader than the circle of specialists and the academy." That was the origin of Christianity and the Religions, a story Fr. Dupuis related to me when I visited him at Gregorian University in early February 2001. It was meant to be an easier-to-read version of Religious Pluralism, something for students who do not need abundant references to authors and historical developments. Circumstances, however, added another dimension to the need for yet another volume. [End Page 182]Christianity and the Religions was ready for publication in early 2001, but Fr. Dupuis was waiting for "official notification" from the Holy See's Congregation for the Doctrine of the Faith regarding its charges that Religious Pluralism contained "serious doctrinal error." By then, the case was in its thirty-second and final month, for later in February 2001 he received word from Cardinal Joseph Ratzinger, prefect of the Congregation, that the charge had been reduced to "ambiguities and difficulties on important points which could lead a reader to erroneous or harmful opinions." Dupuis last appeared before Cardinal Ratzinger and the Congregation's advisers on the day before Dominus Iesus was released in September 2000, accompanied by Fr. Peter-Hans Kolvenbach, superior general of the Jesuits, and Dupuis's advocate and colleague at the Gregorian University, Fr. Gerald O'Collins. Dupuis used the opportunity of a more accessible version of the book in question to address squarely the charges raised against him. He writes in the introduction to Christianity and the Religions: "Suffice it to say that in this new book I have scrupulously avoided all expressions that could raise any misunderstanding or create ambiguity over either the content of the faith or my thought." Dupuis dedicated the book to retired Cardinal Franz Kōnig. He chose to quote an earlier (1963) text by Cardinal Ratzinger on the page following the dedication: "What the Church needs today, as always, are not adulators to extol the status quo, but men whose humility and obedience are no less than their passion for truth: men who brave every misunderstanding and attack as they bear witness; men who in a word, love the Church more than ease and the unruffled course of their personal destiny." In 1999, Ratzinger and Kōnig had exchanged views, point and counterpoint, in the British Catholic weekly, The Tablet, over Dupuis's earlier Religious Pluralism.Fr. Jacques Dupuis died of an apparent stroke on 28 December 2004 at age 81. Although the investigation had brought him increased attention and invitations to speak, he was in Rome, his home since 1984, at the time of his death. When I visited him in 2001 and again heard him speak at the Catholic University of America just twenty-four days before his death, it was clear how much the case and accompanying suspicion had hurt him. Dupuis was principally a theologian who had considered it his good fortune to have lived and taught in India for thirty-six years. He also had taught theology for nearly fifteen years at Gregorian University, the premier university of his religious order. All of the selections have been made to provide the reader with a good introduction to the basic idea of Jacob Boehme. The Six Theosophic Points is the most important of these essays and contains an excellent analysis and more extended treatment of such central concepts in (...) Boehme’s thought as The Unground, the Trinity, Freedom, the Nature of Man, and the Problem of Evil. It will afford the reader a good introduction to Boehme’s peculiar and esoteric dialectic, and it will also be revealing to those who customarily think of Boehme primarily as a mystic. This paper was inspired by Irigaray's suggestion that patriarchal discourse is essentially paranoid, based upon a repressed ambiguity and violence that continually threatens the unity and stability of the subject. Lewis Carroll's 'Locking-Glass World' is employed as the metaphor for a system of meaning that is in the process of breaking down and reveals its shadow side in chaos, violence and power struggles. It is argued that Alice represents an idealized feminine submission to the rules of patriarchal discourse that appears (...) safe and stable but renders the subject powerless to effect change. I contrast this with the encouragement neo-paganism gives its practitioners to construct alternative magical metaphors and to learn through experience. It is valuable for feminist theologians to privilege these flexible techniques in order to avoid the straitjacket of reifying discourse. The article makes the point that the mystical experience is anyway grounded in that which transcends language, and the excess of the mystic finds its expression best in an abundance of meaning and symbol. Irigaray and feminist neo-pagans can in their various ways serve as role models in the process of renegotiating Wonderland and creating a new 'Alice'. (shrink)

We study extensions of Presburger arithmetic with a unary predicate R and we show that under certain conditions on R, R is sparse and the theory of $\langle\mathbb{N}, +, R\rangle$ is decidable. We axiomatize this theory and we show that in a reasonable language, it admits quantifier elimination. We obtain similar results for the structure $\langle\mathbb{Q},+, R\rangle$.

Celle-ci, si elle fait alors l’objet d’une pédagogie qui met au centre l’expérience vécue du sujet, nous oblige à concevoir à nouveaux frais les valeurs que nous (...) accordons aux connaissances apprises. Notre analyse entend démontrer que : 1) de même que dans le domaine éthique, rien n’a de valeur en soi pour le sujet agissant. Mais que 2) la valuation de tout acte est déterminée en situation, alors, 3) dans le domaine de la pédagogie, aucune connaissance n’a de valeur en soi pour l’élève. 4) Ainsi la première tâche de l’enseignant.e est de former l’élève à des processus de valuation efficaces. Si notre hypothèse est juste alors cette tâche devient à la fois un point de départ important de la pédagogie pragmatiste et un impératif incontournable de l’éthique enseignante. -/- The present article examines how Dewey addressed the problem of value, as well as the consequences that this solution had for his educational theory. More specifically, I aim to show that Dewey’s effort to rethink means and ends within the process of valuation contributes to a recasting of moral inquiry. If moral inquiry becomes part of a pedagogy that focuses upon the lived experience of the subject, this compels us to rethink the value we attribute to acquired knowledge. My analysis will demonstrate 1) that even within the ethical domain, nothing has value in itself for the acting subject, but that 2) the value of all acts must be determined within specific situations, and therefore 3) within the domain of pedagogy, no knowledge has value in and of itself for the student. 4) Thus the first task of the teacher is to teach students how to evaluate questions of value, which will push them to determine for themselves what knowledge has value. If my hypothesis is correct, this task becomes simultaneously an important starting place for pragmatist pedagogy and a cornerstone of a new ethic of teaching. (shrink)

With this proposal, we wish to revisit the Idea of the University in the perspective of the democratic project of the American philosopher and pragmatist John Dewey. Our hypothesis consists in the thesis that the deweyen project confronts the problem of the social distribution of knowledge, in the aim of giving us the means to transform the latter. In this way, if we consider that the university is part of this distribution through its student learning function, then our purpose is (...) to demonstrate that this learning is currently guided by an individual intelligence paradigm harms that the development of collective intelligence. For John Dewey, the latter is one of the central means of his democratic project which would reconcile the Idea of a University with real University institutions. "Philosophy for Children: a Way to Reconcile Disciplinary Teaching and School Life? Drawing mainly on John Dewey's writings, this contribution aims to extend the dualism of a traditional conception of education at the epistemological, pedagogical and organizational levels. This conception was already criticised by this author at the beginning of the 20th century and still remains widely present today among the school community. Through this approach, we demonstrate that the dualist approach is as many obstacles to be removed in the (...) process both to improve and rebuild a better education. The reception of Dewey's work has suffered, in terms of his political philosophy, from a certain mistrust. First, in the field of education, Dewey's refusal to grant "ultimate" or "high" status to certain values, even those of the French Republic, has made him a mistrusted figure.1 Apart from the pedagogues of Education Nouvelle, which defied the then dominant "Cartesian tradition of the dualistic philosophy of reason" in France, Dewey was little studied before the 1960s. We apply our results for axiomatizing the reduct to the theory of modules of non principal ultraproducts of separably closed fields of fixed but non zero imperfection degree.

This paper investigates how specific notions of gender and ethnicity are integrated into diversity discourses presented on 241 top European company websites. Large European companies increasingly disclose equality and diversity policies in statements on websites. Such statements may be used to promote an ethical image of the company in terms of how well it manages diversity and guards against discrimination. In this paper, we argue that diversity statement discourses are important as they play a key part in socially constructing how (...) diversity should be regarded in the company by minority and majority groups, as well as indicating corporate values to external stakeholders. Sometimes, the notions of gender or ethnic diversity are positioned as a liability in need of protection, whilst in others, as a source of competitive advantage. We find evidence of use of discursive tools such as problematisation, rationalisation, fixation, reframing and naturalisation of the notions of gender and ethnic diversity, reinforced by use of symbols, such as statistics, photographs, membership badges and awards. Few statements directly associate gender and ethnic diversity with enhanced corporate performance. We found that diversity statements sometimes appear to reinforce existing business stereotypes of women and people from ethnic minorities, and in a few discourses, create new ones, particularly evident in photographs illustrating the diversity web pages. Professors Maclntyre and Rosenberg are more inclined than I to believe that 'philosophy' names a natural kind - a distinctive sort of inquiry with a continuous history since the Greeks. Their criticisms of my book reflect this disagreement. Mr. Montefiore brings to light various ambiguities in my use of such terms as "edifying philosophy" and "Continental philosophy". His criticisms make good points against the concluding portions of Philosophy and the Mirror of Nature. Professors Bennett and Turnbull rightly say that (...) Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)

Chaotic systems with hidden multiscroll attractors have received much attention in recent years. However, most parts of hidden multiscroll attractors previously reported were repeated by the same type of attractor, and the composite of different types of attractors appeared rarely. In this paper, a memristor-based chaotic system, which can generate composite attractors with one up to six scrolls, is proposed. These composite attractors have different forms, similar to the Chua’s double scroll and jerk double scroll. Through theoretical analysis, we find (...) that the new system has no fixed point; that is to say, all of the composite multiscroll attractors are hidden attractors. Additionally, some complicated dynamic behaviors including various hidden coexisting attractors, extreme multistability, and transient transition are explored. Moreover, hardware circuit using discrete components is implemented, and its experimental results supported the numerical simulations results. (shrink)

Summary In this paper we examine the reaction of the Leiden low-temperature laboratory of Heike Kamerlingh Onnes to new ideas in quantum theory. Especially the contributions of Albert Einstein (1906) and Peter Debye (1912) to the theory of specific heat, and the concept of zero-point energy formulated by Max Planck in 1911, gave a boost to solid state research to test these theories. In the case of specific heat measurements, Kamerlingh Onnes's laboratory faced stiff competition from Walter Nernst's Institute of (...) Physical Chemistry in Berlin. In fact, Berlin got the better of it because Leiden lacked focus. After the liquefaction of helium in 1908, Kamerlingh Onnes transformed his laboratory into an international facility for low temperature research, and for this reason it was impossible to make headway with the specific heat measurements. In the case of zero-point energy, Leiden developed a magnetic research programme to test the concept. Initially the balance of evidence seemed to be tipping in favour of zero-point energy. After 1914, however, Leiden would desert the theory in fovour, of a concept from calssical physics. A curious move that illustrates Kamerlingh Onnes's discomfort with the new quantum theory. We consider first-order theories of topological fields admitting a model-completion and their expansion to differential fields . We give a criterion under which the expansion still admits a model-completion which we axiomatize. It generalizes previous results due to M. Singer for ordered differential fields and of C. Michaux for valued differential fields. As a corollary, we show a transfer result for the NIP property. We also give a geometrical axiomatization of that model-completion. Then, for certain differential valued fields, we extend (...) the positive answer of Hilbert’s seventeenth problem and we prove an Ax–Kochen–Ershov theorem. Similarly, we consider first-order theories of topological fields admitting a model-companion and their expansion to differential fields, and under a similar criterion as before, we show that the expansion still admits a model-companion. This last result can be compared with those of M. Tressl: on one hand we are only dealing with a single derivation whereas he is dealing with several, on the other hand we are not restricting ourselves to definable expansions of the ring language, taking advantage of our topological context. This paper aims at presenting the argument for the modification of Dennis Earl’s ‘four-sentence paper’ template into the ‘six-line essay” writing intervention. The underlying reason for this research is a relative paucity of literature covering the topic of philosophy writing interventions at a beginner’s level. In order to fill this gap, the paper takes the following course. For general background, it presents the general views on teaching essay writing and the relative unavailability of philosophy-directed methods and techniques. It then describes (...) Earl’s template in relative detail. Further, it refers to my experience teaching philosophical writing to University of Zululand students. Next, it describes the specific group of students with whom I first tried the method in 2019 and whose needs prompted the modifications. It then explains the ’six-line essay’ model step by step, commenting on the rationale behind each step and the way in which it is presented to students. True to form, the paper also presents objections and the relevant counter-arguments. Finally, the paper points to the possibility of further, more structured research, with formal questionnaires/structured interviews and their subsequent analysis. (shrink)

Professors Maclntyre and Rosenberg are more inclined than I to believe that ‘philosophy’ names a natural kind -- a distinctive sort of inquiry with a continuous history since the Greeks. Their criticisms of my book reflect this disagreement. Mr. Montefiore brings to light various ambiguities in my use of such terms as “edifying philosophy” and “Continental philosophy”. His criticisms make good points against the concluding portions of Philosophy and the Mirror of Nature. Professors Bennett and Turnbull rightly say that (...) This paper investigates how specific notions of gender and ethnicity are integrated into diversity discourses presented on 241 top European company websites. Large European companies increasingly disclose equality and diversity policies in statements on websites. Such statements may be used to promote an ethical image of the company in terms of how well it manages diversity and guards against discrimination. In this paper, we argue that diversity statement discourses are important as they play a key part in socially constructing how (...) diversity should be regarded in the company by minority and majority groups, as well as indicating corporate values to external stakeholders (investors, government, community, press etc.). Sometimes, the notions of gender or ethnic diversity are positioned as a liability in need of protection, whilst in others, as a source of competitive advantage. We find evidence of use of discursive tools such as problematisation, rationalisation, fixation, reframing and naturalisation of the notions of gender and ethnic diversity, reinforced by use of symbols, such as statistics, photographs, membership badges and awards. Few statements directly associate gender and ethnic diversity with enhanced corporate performance. We found that diversity statements sometimes appear to reinforce existing business stereotypes of women and people from ethnic minorities, and in a few discourses, create new ones, particularly evident in photographs illustrating the diversity web pages. Analysis of sites of newly integrated DNA in cellular genomes is important to several fields, but methods for analyzing and visualizing these datasets are still under development. Here, we describe tools for data analysis and visualization that take as input integration site data from our INSPIIRED pipeline. Paired-end sequencing allows inference of the numbers of transduced cells as well as the distributions of integration sites in target genomes. We present interactive heatmaps that allow comparison of distributions of integration sites to (...) genomic features and that support numerous user-defined statistical tests. To summarize integration site data from human gene therapy samples, we developed a reproducible report format that catalogs sample population structure, longitudinal dynamics, and integration frequency near cancer-associated genes. We also introduce a novel summary statistic, the UC50, which provides a single number summarizing possible clonal expansion. Using these tools, we characterize ongoing longitudinal characterization of a patient from the first trial to treat severe combined immunodeficiency-X1, showing successful reconstitution for 15 years accompanied by persistence of a cell clone with an integration site near the cancer-associated gene CCND2. In Dellunde et al. 997–1015), we determined the complete theory Te of modules of separably closed fields of characteristic p and imperfection degree e, eω{∞}. Here, for 0≠eω, we describe the closed set of the Ziegler spectrum corresponding to Te. Further, we establish a correspondence between certain submodules and n-types and we investigate several notions of dimensions and their relationships with the Lascar rank. Finally, we show that Te has uniform p.p. elimination of imaginaries and deduce uniform weak elimination of (...) imaginaries. (shrink)

We consider valued fields with a distinguished isometry or contractive derivation as valued modules over the Ore ring of difference operators. Under certain assumptions on the residue field, we prove quantifier elimination first in the pure module language, then in that language augmented with a chain of additive subgroups, and finally in a two-sorted language with a valuation map. We apply quantifier elimination to prove that these structures do not have the independence property.

For more than a century, there has been some discussion about whether medieval Arabic al-jabr has its roots in Indian or Greek mathematics. Since the 1930s, the possibility of Babylonian ultimate roots has entered the debate. This article presents a new approach to the problem, pointing to a set of quasi-algebraic riddles that appear to have circulated among Near Eastern practical geometers since c. 2000 BCE, and which inspired first the so-called “algebra” of the Old Babylonian scribal school and later (...) the geometry of Elements II. The riddles also turn up in ancient Greek practical geometry and Jaina mathematics. Eventually they reached European mathematics via the Islamic world. However, no evidence supports a derivation of medieval Indian algebra or the original core of al-jabr from the riddles. (shrink)

This article takes as its starting point the observation that neoliberalism is a concept that is ‘oft-invoked but ill-defined’. It provides a taxonomy of uses of the term neoliberalism to include: an all-purpose denunciatory category; ‘the way things are’; an institutional framework characterizing particular forms of national capitalism, most notably the Anglo-American ones; a dominant ideology of global capitalism; a form of governmentality and hegemony; and a variant within the broad framework of liberalism as both theory and policy discourse. It (...) is argued that this sprawling set of definitions are not mutually compatible, and that uses of the term need to be dramatically narrowed from its current association with anything and everything that a particular author may find objectionable. In particular, it is argued that the uses of the term by Michel Foucault in his 1978–9 lectures, found in The Birth of Biopolitics, are not particularly compatible with its more recent status as a variant of dominant ideology or hegemony theories. It instead proposes understanding neoliberalism in terms of historical institutionalism, with Foucault’s account of historical change complementing Max Weber’s work identifying the distinctive economic sociology of national capitalisms. The passionate and staunch defence of logic of the controversial thinker Ibn Ḥazm, Abū Muḥammad ʿAlī b. Aḥmad b. Saʿīd of Córdoba (384-456/994-1064), had lasting consequences in the Islamic world. Indeed, his book Facilitating the Understanding of the Rules of Logic and Introduction Thereto, with Common Expressions and Juristic Examples (Kitāb al-Taqrīb li-ḥadd al-manṭiq wa-l-mudkhal ilayhi bi-l-alfāẓ al-ʿāmmiyya wa-l-amthila al-fiqhiyya), composed in 1025-1029, was well known and discussed during and after his time; and it paved the way for the studies (...) of his compatriots Ibn Bājjah (d. 1138), Ibn Ṭufayl (1185), and Ibn Rushd (1198), who each gave demonstrative reasoning a privileged place within the methods of attaining knowledge. Unfortunately, as too often in the history of science, Ibn Ḥazm’s innovative perspectives and contributions in logic have been overlooked or considered with an attitude of contempt. On the one hand, his work has been seen, at best, as promulgating the benefits of studying Aristotle’s logic, so that his contribution is assessed as more didactical than conceptual. And on the other hand, those who do examine his innovations often consider them to be mistaken. As indicated by Chejne (1984, p. 2) contempt towards the logical work of Ibn Ḥazm was also present in its reception by the Eastern philosophers who accused him of deviating from Aristotelian logic and of dabbling in things beyond his capability. However, a reassessment of his work on logic has since begun, by delving into the ways the thinker of Córdoba studied the links between deontic and modal qualification of propositions. In this context Lameer’s (2013) paper on the logical sources of Ibn Ḥazm is worth mentioning; the author (p. 417, footnote 1) observes that, although, strictly speaking, it was al-Fārābī who first drew the parallelism between deontic and modal concepts, it was Ibn Ḥazm who developed it and worked it out in a more precise manner. A primary aim of this paper is to help fill some of these gaps by stressing the role of the work of Ibn Ḥazm in developing a notion of deontic necessity deeply rooted in legal normativity, and in explicitly discussing the transference between deontic and modal concepts. According to our view; the basic units of Islamic deontic logic are what we might call, indulging in terminological anachronism, heteronomous imperatives. As it turns out, the heteronomy of imperatives within Islamic legal systems contrasts with those of the purely moral realm, which seem to be closer to an autonomous conception of moral law. There it concurs again with Leibniz’s proposal to define obligatory as “what is necessary for a good person to do”. In the present paper, we will focus on the heteronomous imperatives of legal systems rather than on the imperatives of the purely moral realm. In this context, the work of Ibn Ḥazm extends the parallelism between the necessity of events and that of human actions stressed by his predecessors. According to our understanding, Ibn Ḥazm’s parallelism can be rendered explicit formally by means of a conditional (or hypothetical) structure shared by both deontic and modal propositions. Moreover, this structure makes apparent that this parallelism displays an underlying system of “degrees”. Indeed, while in the domain of events, given some conditions, it makes sense to distinguish between an event that is more likely to happen than another. Ibn Ḥazm speaks of near and distant possibility (such as the higher degree of likelihood of rain, given the condensation of clouds in December, and its lower degree, when the condensation occurs in summer); and, in the domain of actions, the Islamic notion of weighting actions determines degrees of virtue (or of legal and moral value). So whereas the degree of virtue of performing a forbidden act as determined by the distribution of sanction and reward is 0, we obtain the same value by pondering the likelihood of an impossible event to take place. Furthermore, as discussed in section II.3.2, the system of values at work in the parallelism can be seen as opening the way to a more direct correspondence. Thus, while in the realm of nature, likelihood of occurrence of an event is dependent upon the conditions specific to the occurrence of that event; while, in the realm of jurisprudence, likelihood of performing an action is dependent upon the distribution of reward and sanction specific to that action (being that, given the choice to perform or not perform a given action, those that will be rewarded are more likely to be performed than those that are not). According to this perspective, the point of the parallelism is that both deontic and modal qualifications measure the degree of an action or event to become actual; that is – indulging once more in anachronism (but this time from the Leibnizian background) – the degree measures how feasible (facile) an action or event may be. This suggests that Ibn Ḥazm’s perspectives already herald the links to probability and possibility explored by Leibniz six centuries later – see for example Leibniz’s (1671, A VI, I, p. 424-26) use of probability in the context of conditional right. Nevertheless, it also shows a crucial difference to the approach developed in the Elementa Jura Naturalis: whereas Leibniz’s studies seek to define what is to be just or virtuous, the logical system of deontic imperatives within Islamic jurisprudence presupposes that what is to be virtuous has already been settled. Determining what is to be virtuous is not achieved by logical reasoning within the system of legal jurisprudence, but by delving into the higher objectives of the Sharīʿa. While developing our point, we will delve into the logical structure of the heteronomous imperatives. This distinguishes our contribution from the existing literature, such as the papers of Chejne (1984), Lameer (2014), and Guerrero (1997, 2010, 2014), which do not provide a logical analysis of the deontic concepts put into work by Ibn Ḥazm. The true antecedent to the present paper is the work of Farid Zidani (2007, 2015), who, so far as we know, was the first to undertake such a task. Some of our own developments and general epistemological thoughts go beyond Ibn Ḥazm’s framework and motivations; mainly those contained in sections II.3.2 and IV. However, according to our view, these reflections suggest that Ibn Ḥazm’s approach has the substance for a broader and deeper exploration of the logic of norms. The paper is structured as follows:I.Ibn Ḥazm’s Logic of Heteronomous Imperatives. After presenting some extracts of the relevant text, we proceed by providing a formal reconstruction of the five forms of deontic modalities. II. A Landmark in the History of the Logical Analysis of Norms. Duties and Modalities. In this section, we study the transferences from deontic to modal necessity and possibility. We briefly compare the deontic system of Islamic Jurisprudence with that of Leibniz.III. Leibniz and Hypothetical Imperatives in Law.IV. Beyond Ibn Ḥazm: Conclusions and the Work Ahead. We will conclude the paper by discussing briefly some conceptual points that distinguish the logic of heteronomous imperatives from contemporary deontic logic.
